Service of Subpoenas
Subpoenas and other legal information requests seeking information from Happen, Inc. (f/k/a Happen, Inc.) or Happen Bank, National Association (f/k/a Happen Bank , National Association) (collectively, “Happen”) should be served upon Happen c/o Corporation Service Company, at the following address:

You may also serve Happen through its registered agent for service of process in other states where a registered agent is specifically authorized to accept legal process on Happen’s behalf.
While you may submit a courtesy copy of your request or questions to subpoenas@happen.com, submitting requests via email alone is not proper service. Happen reserves, and in no way waives, the right to object to service of process on any basis.
Happen does not accept service of subpoenas at any Happen office locations.
Processing Time
Subpoena fulfillment typically takes up to 90 days after proper service. More time may be needed if extensive information is sought or if insufficient information is provided.
Subpoena Inquiries
Subpoenas and other legal information requests should:
Be specific with respect to what is being requested. Requests seeking “any and all” documents may require clarification and/or additional time to process.
Identify the court/jurisdiction, case number, and contact information of the requestor.
Be signed and dated by the proper court and/or officer of the court.
Include adequate information to identify responsive documents (e.g., full account numbers, SSN, name & DOB).
Provide a contact email address where we can deliver responsive documents and, if needed, request additional information to process the request.
Delivery Method
We use Kiteworks to securely deliver responsive documents. When your responsive documents are ready, you will receive an email from kiteworks@happen.com with a link to a secure message.
To access the secure message, you will be required to create an account with Kiteworks. Simply open the link in the email, enter your email address, and follow the prompts. Message attachments are accessible for 30 days only.
Fees
We reserve the right to charge reasonable administrative fees and costs (unless otherwise prohibited by law) for producing documents, providing affidavits, and/or responding to any subpoena or other legal information requests. While prepayment of subpoena processing is accepted, Happen reserves the right to charge for additional time and/or costs incurred in excess of the prepaid amount. We will not accept cash as a form of payment.
